There are two types of appeals forms under the Program:
- Notice of Appeal of Rejected Application (Schedule 4), which applies if your Application has been rejected because it does not constitute a Receivable Claim.
- Notice of Appeal of Denied Receivable Claim (Schedule 5), which applies if your Application has been denied compensation under the Program.
All appeals forms must be completed in English, French, or Portuguese. Forms submitted in any other language will be rejected. Note that documents and other information required along with the Notice of Appeal of Denied Receivable Claim form (as described in that form) may be completed in other languages. All appeals forms must be completed, signed, and dated upon submission in order to be considered.
Appeal Online
To submit an appeal online, please:
- Download, print, and complete the correct appeals form on paper (Schedule 4 or Schedule 5 depending on the applicable situation).
- Upload and submit the appeal on Upload Documents.
Note: submitting an Appeal online requires the Applicant’s name and the Application number.
Appeal by Email
To submit an appeal by email:
- Download, print, and complete the correct appeals form on paper, either Schedule 4 or Schedule 5 depending on the applicable situation.
- Email these scanned forms and documents (as one or more email attachments) to [email protected].
Appeal by Regular Mail
To submit an appeal by regular mail:
- Download, print, and complete the correct appeals form on paper, either Schedule 4 or Schedule 5 depending on the applicable situation.
- Mail these scanned forms and documents to one of the Program’s Regional Centers.
The AVAT No Fault Compensation Scheme, as detailed in the Protocol and its Schedules.
A written claim for compensation completed by an Applicant on the application form approved by and provided by the Administrator, as set forth in Schedule 2 to the Program's Protocol, which must be accompanied by all Supporting Evidence, using the prescribed form in Schedule 3 to the Program’s Protocol.
Any duly completed Application for compensation (i) that is accompanied by all Supporting Evidence, (ii) that is filed/submitted by an Applicant prior to the end of the Reporting Period with the Administrator, and (iii) that is found by the Administrator, and/or by the Administrator’s Vice President of Risk Consulting to be receivable as provided in Section 4 or Section 7 of the Program's Protocol.
An appeal filed by a Claimant, following the denial of his Receivable Claim by the Review Panel, in accordance with the procedure described in Section 8 of the Program's Protocol and using the form in Schedule 5 of the Program's Protocol.
Either (as the context requires):
- The Patient who directly submits an Application for compensation under the Program for himself; or
- In the event the Patient has died, is a child, or is disabled or otherwise lacks the legal capacity to submit an Application for himself, then the Applicant must be a person who is a duly authorized legal heir (in the case of death), parent, legal guardian, or other legal representative of the Patient.
